
While everyone is focusing on the ruling by US Federal judge Henry Hudson that it's unconstitutional for the US government to compel Americans to buy health insurance, it's worth considering the judge's financial links with Ken Cuccinelli, the Attorney General of Virginia who brought the lawsuit in front of Hudson's court. And if nothing else, it tells us that the US court and political system is rotten and dirty to the core.
When you read the report in the Los Angeles Times, you learn that Hudson, an appointee of President George W. Bush, had according to financial disclosure records received dividends from Campaign Solutions, a political consulting firm with strong Republican ties.
The Seattle Times tells us that Cuccinelli paid the same firm thousands of dollars for website services and credit-card processing, including a $166 payment as recently as June, according to Virginia campaign records. The paper reports: "Cuccinelli paid Campaign Solutions for $9,000 of work this year and last. When Hudson's investment became public, Cuccinelli canceled his account with the firm. Hudson said he and his wife invested in the firm before his appointment to the bench. They did so at the invitation of friend and neighbor (Rebecca) Donatelli, the company's founder and a major Republican fundraiser, he said.".
Significantly, Donatelli worked for Sarah Palin.
This case is absolutely filthy. As James J. Sample, an associate professor at Hofstra Law School, told the TPMuckraker site, it's not a good look. "Federal judges are required by statute to disqualify themselves from hearing a case whenever their impartiality might reasonably be questioned,'' Sample said. "It's a hyper-protective rule and for good reason. At the very least, his continued financial interest in Campaign Solutions undermines the perceived legitimacy of his decision."
